Agreement to Terms

By downloading, installing, or using the Bayarsama mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and CrucibleCraft ("we", "us", or "our").

If you do not agree to these Terms, do not use the App. By continuing past the welcome screen, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy.

Description of the App

Bayarsama is a bill-splitting calculator designed to help groups divide restaurant bills, shared expenses, and other costs. The App performs arithmetic calculations based on values you enter and presents the results for informational purposes only.

Bayarsama is not a financial services product. It does not provide financial advice, accounting services, tax advice, or any regulated financial service. All calculations are estimates intended to assist with informal cost-sharing arrangements. You are solely responsible for verifying any amounts before making payments.

Intellectual property

The App and all of its contents — including but not limited to software code, design, graphics, user interface elements, icons, text, and branding — are the exclusive property of CrucibleCraft and are protected by applicable copyright, trademark, and intellectual property laws.

You may not copy, reproduce, modify, distribute, reverse-engineer, decompile, or create derivative works based on the App or any part of it without our prior written consent. Unauthorised use may result in legal action.

Licence to use

Subject to your compliance with these Terms, CrucibleCraft grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial purposes.

You may not:

• Use the App for any unlawful purpose or in violation of any applicable law or regulation
• Sell, sublicense, rent, lease, or transfer the App or your rights to use it
• Remove or alter any proprietary notices, labels, or marks on the App
• Use the App in any manner that could damage, disable, overburden, or impair it
• Attempt to gain unauthorised access to any part of the App or its related systems

Bayarsama Pro — subscription

Bayarsama offers an optional paid subscription ("Bayarsama Pro") that unlocks additional features. All subscriptions are purchased through and managed by the Apple App Store. By purchasing Bayarsama Pro, you also agree to Apple's Media Services Terms and Conditions.

• Pricing: Subscription prices are set by CrucibleCraft and displayed in the App at the time of purchase, in your local currency as determined by Apple.
• Billing: Subscriptions are billed by Apple on a recurring basis (quarterly or annually, depending on the plan selected). A one-time lifetime purchase is also available. Your Apple ID account is charged upon purchase confirmation.
• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period; you retain access to Pro features until that date.
• Free trials: Where a free trial is offered, unused portions of the trial are forfeited upon purchase of a subscription.
• Price changes: We reserve the right to change subscription pricing. You will be notified of any price changes through the App Store, and continued use after the change takes effect constitutes acceptance of the new price.

Refunds

All purchases are processed by Apple. CrucibleCraft is not the merchant of record and does not process payments directly. Refund requests are handled by Apple in accordance with their standard refund policy.

To request a refund, visit reportaproblem.apple.com or contact Apple Support. CrucibleCraft does not have the ability to issue refunds directly.

Disclaimers

The App is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, CrucibleCraft expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be uninterrupted, error-free, or free of viruses or other harmful components
• Warranties regarding the accuracy, reliability, or completeness of any calculation or result produced by the App

Calculation results are estimates only. Bayarsama performs arithmetic based on the values you enter. Rounding, currency conversion, tax interpretations, and other factors may cause results to differ from actual amounts. Always verify totals independently before making payments. CrucibleCraft accepts no responsibility for any financial loss, dispute, or inconvenience arising from reliance on the App's calculations.

Not financial advice. Nothing in the App constitutes financial, accounting, legal, or tax advice. You should consult a qualified professional for advice specific to your circumstances.

Limitation of liability

To the fullest extent permitted by applicable law, CrucibleCraft and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — arising out of or relating to your use of, or inability to use, the App.

In no event shall CrucibleCraft's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the App exceed the total amount you paid for Bayarsama Pro in the twelve (12) months immediately preceding the claim, or the equivalent of USD $10.00 (ten US dollars) if no such amounts were paid.

These limitations apply regardless of the theory of liability (contract, tort, negligence, or otherwise), even if CrucibleCraft has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless CrucibleCraft and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the App, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

Third-party services

The App uses third-party services including Google Firebase (Analytics, Crashlytics, Remote Config) and Apple's StoreKit framework. Your use of the App is also subject to the terms and privacy policies of these third parties. CrucibleCraft is not responsible for the practices or content of any third-party service.

Termination

CrucibleCraft reserves the right to suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion.

Upon termination, your licence to use the App ceases immediately. Sections of these Terms that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — shall continue to apply.

Governing law

These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. You agree to submit to the non-exclusive jurisdiction of the courts of Malaysia for the resolution of any disputes arising out of these Terms or your use of the App.

If you are a consumer residing in a jurisdiction whose local laws grant you mandatory rights that cannot be excluded or limited by a choice-of-law clause, those rights continue to apply to the extent required by local law. This includes but is not limited to consumers in the European Union, United Kingdom, Australia, Brazil, Canada, Japan, South Korea, and any other jurisdiction with mandatory consumer protection legislation. Nothing in these Terms is intended to limit any rights you have under such legislation in your country of residence.

EU and UK consumers: You may bring proceedings in the courts of your country of residence. You also have the right to a 14-day cooling-off period for digital purchases, which is managed by Apple as the merchant of record. You may additionally use the European Commission's Online Dispute Resolution platform for complaints.

Export compliance

You agree to comply with all applicable export and re-export control laws and regulations, including the U.S. Export Administration Regulations and any restrictions issued by the United Nations, European Union, or other applicable authorities. You may not use or distribute the App in any country that is subject to a comprehensive trade embargo, or in violation of any applicable sanctions programme.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.

Entire agreement

These Terms, together with our Privacy Policy and Apple's Media Services Terms and Conditions, constitute the entire agreement between you and CrucibleCraft regarding your use of the App. These Terms supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter herein.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you within the App. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. If you do not agree to the revised Terms, you should stop using the App.
